We appreciate that writing a Will is not the most enticing of prospects but with your assitance we can make it a far simpler process and ensure that your hard earned assets go to the people you want them to. Whether your estate is small or large, simple or complex, we can help.
Before you meet with us, it might be worth giving some thought to the following subjects:
Executors/Trustees
Your Executors or Trustees are the people who you choose to distribute your estate when you die, according to your wishes. Generally, this will be your spouse/partner. But whoever you choose, they should be someone who you consider totally trustworthy and responsible. It is also a good idea to choose more than one person as Executor in case the person you have chosen should die before you.
Funeral Arrangements
One of the things you can stipulate in your Will is your funeral arrangements. For example, would you prefer to be buried or cremated and where you would want your funeral to take place?
Gifts
Write a list of any particular gifts you want to leave in your Will such as jewellery, furniture, cars and pets and decide who you would like to receive these specific bequests.
Guardians
If you have children under the age of 18, or 16 in Scotland, (or even if you are thinking of starting a family), you will need to appoint at least two guardians in your Will.
To help you choose the best people, consider their age and also whether they would be willing and able to look after your children. Of course, you will also have to ask their permission.
Alternative Beneficiaries
Who would you like to inherit your estate should both you and your spouse/partner die and all your beneficiaries predecease you.
Will Storage
Proper storage of your Will is of fundamental importance. With Regency Wills we will store your Will for you in a secure, fireproof and waterproof environment. Each Will is seperately insured and the client is provided with a copy of their Will, certificate of storage and cards to hand their Executors so that they too know where the Will is stored.
Professional Executors & Trustees
Obviously a death is a highly stressful situation and very often family members feel unable to cope with everything necessary to obtain Probate to the Will and administer the estate. Perhaps therefore you would prefer to appoint an Executor or Trustee who can carry out the necessary legal work efficiently, speedily and sensitively and at a reasonable cost to the client.
No-one knows what the future holds but we can help you prepare for it.
